Lets Talk About Asset Protection
Last year, the Fortune Law Firm posted a story on Facebook about a dentist who only referred his patient to a specialist, but had been included in her lawsuit with the specialist nonetheless. Several doctors posted positive responses to this story such as…”I can relate to this”…and…”the same thing happened to me.”
However, one doctor posted…”This is just a scare tactic. They just want us to hire them. I’ve been practicing for over 30 years and I’ve never been sued.”
OK…let’s talk about it. This doctor brings up three points:
“(The story) is just a scare tactic.”
“They just want us to hire them.”
“…I’ve never been sued.”
First, if you take out the word “just”, then we are guilty as charged. The story IS a scare tactic…but not “just” a scare tactic. Stories are meant to inform, remind, educate and…yes, at times…scare us enough to wake us up from the day-to-day grind to help us take action on something that is important.
Second, if you take out the word “just” then we are guilty as charged again. Of course we wanted you to hire us. We are in the business of protecting your assets. In your case, you did not spend time and treasure in school “just” to have patients hire you. Your desire is to take the skills you acquired and provide care for your patients…and oh…by the way…be fairly compensated for it. You hired our skills to protect you so you can provide that care with peace of mind.
Third…”I’ve been practicing for over 30 years and I’ve never been sued.” We are happy for this doctor, but what’s his point? Is the suggestion that only doctors who have been sued in the past can be sued in the future? You may have a spotless driving record, but that doesn’t mean you don’t get car insurance. Just in case. You may be as healthy as can be, but that doesn’t mean you don’t get health insurance. Just in case. You don’t want your assets exposed in a lawsuit, so you hired the Fortune Law Firm…just in case!
Could you go through your entire career without a legal incident? Of course, but that is atypical. Kevin B. O’Reilly wrote an article for the American Medical Association entitled 1 in 3 Physicians Has Been Sued; by Age 55, 1 in 2 Hit with Suit. The title says it all.
And lest we forget, the AMA article refers only to your risk of medical liability. There is the other threat of what we call life-related lawsuits that can threaten you.
