At The Fortune Law Firm, Ltd. (which we may refer to as “Fortune Law Firm,” “we,” “us,” “our,” or “ours”), we really appreciate your use of our products. We want you to be comfortable knowing exactly what we do with the information we collect from you. To be candid and transparent, we have prepared and made public this Privacy Policy.

Because it is not feasible for us to sit down with each of you to go over the policy and get your individual assent, nor to negotiate a separate policy with everyone who uses our Services (defined below), practicality and sound business practices demand that your assent be granted automatically by pairing it with the use of our products and services. Your privacy is very important to us. We are committed to safeguarding the information you entrust to us through the use of our Services.

We are also committed to complying with data protection laws and principles. Accordingly, we commit to all of the following:

We are committed to promoting and complying with United States consumer and privacy rights and promise that you will not face any discrimination from us in response to your choice to exercise those rights.

However, as it is not possible to guarantee 100% the security of data and information transmission over the internet, we cannot warrant the security of any information you transmit to us. Therefore, if you choose to transmit data, you do so at your own risk. We will, however, take reasonable steps to incorporate appropriate technical and organizational measures to protect against unauthorized or unlawful use, processing, or disclosure of your information.

To that end, access to your personal information is password-protected for your privacy and security. We use industry-standard SSL-encryption to protect data transmissions. We work to ensure the integrity and security of our network and systems. Information about you that is maintained on our systems is protected using industry standard security measures that include, but are not limited to, security measures in place to protect the loss, misuse, and alteration of the information under our control. We do not store any information on the Website. All information we collect from you is stored via Hubspot, and you can view its privacy policy at https://legal.hubspot.com/privacy-policy. Additionally, the Website may contain links to other Internet web sites. We are not responsible for the privacy practices or the content of such internet web sites.

Scope of this Privacy Policy

This Privacy Policy covers our treatment of personally identifiable information[1]  and personal information[2]we collect when you use our Services. This Privacy Policy does not apply to any information collected from by other means.

This Privacy Policy does not apply to the practices of companies that we do not own nor control, nor to people that we do not employ nor manage. It does not apply to services offered by third-party services we may use, including advertisers who may advertise on our Website, or other sites that may be linked from our Website. For these third parties, we encourage you to familiarize yourself with their respective privacy policies.

If any Services include social networking, group chat features and functionality, forum features, or other interactive features, your use of those features will be accessible by other users of the Services. Under those circumstances, it will be Your responsibility to limit how much you share of the personal data or information you desire to be kept private. You acknowledge and agree that you have no expectations of privacy when it comes to using those features.

Children

We do not knowingly collect or maintain personally identifiable information from persons under 13 years of age, and no part of the Website is directed at persons under 18. If you are under 18 years of age, then please do not use the Website. If we learn that personally identifiable information of persons less than 13 years of age has been collected without verifiable parental consent, we will take the appropriate steps to delete this information. Information We Collect[3]

The information we collect fits broadly into one of two categories: personally identifying information (that’s the information that could potentially be used to identify you) and non-personally identifying information (information that is insufficient to identify you).

Non-Personally Identifying Information

Each time a visitor comes to our Website, Fortune Law Firm’s servers, like most on the web, collect some basic technical information, including the following:

We, and third-party service providers that we engage to provide services to us (“Contractors”), use the following kinds of cookies:

Strictly Necessary Cookies: These cookies are essential to provide you with services from our website and to enable you to use its features. For example, they allow you to log in to members-only areas of our site and load the content of the pages you request. Without these cookies, the services that you ask for cannot be provided. We only use these cookies to provide you with those services.

Functionality Cookies: These cookies allow our site to remember the choices you make, such as remembering your login details and remembering the changes you make to other parts of our site which you can customize (your preferences). The purpose of these cookies is to provide you with convenience and a more personal experience on our site.

The purpose of these cookies is to analyze web page traffic to further optimize how users access relevant content.

Google Analytics: The site uses Google Analytics (an analytical/performance cookie) to analyze how it is used. The cookie collects standard internet log information and visitor behavior information in an anonymous form, from which individual users are unidentifiable. This information is transmitted to Google and processed to compile statistical reports on activity on the Website. These reports allow us to optimize our user experience. Third Parties: Third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

Most browsers allow you to refuse to accept cookies or delete cookies. The methods for doing so vary from browser to browser, and from version to version. You can obtain up-to-date information about blocking and deleting cookies via the support pages of your browser operator. However, disabling cookies may lead to limited access to our online services.

We, and our Contractors, may also use web tracking technologies like web beacons, pixel tags, and clear GIFs to operate our Services efficiently and collect data related to the use of our Services. These services can be used, for example, to determine whether you have opened an email that we have sent to you.

Some of the Services include social media features, such as “Share This” functionality/buttons. These features may collect your Internet protocol address, which page(s) you are visiting on our Website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly in the websites. Your interactions with these features are governed by the privacy policies of the companies that provide them.

When you visit our Website, register, subscribe to the blog or a product, or leave a comment on the blog, your IP address may also be collected. Different jurisdictions have reached different conclusions about whether an IP address constitutes personally identifying information or non-personally identifying information. Ordinarily, an IP address can only identify a user’s computer, and not the user individually. In some cases, though, if an IP address is paired with other identifying information, it is possible to identify the user.

Personally Identifying Information

The personally identifying information we collect depends on how you interact with our Services. If you just visit the Website, your IP address will be logged, but we won’t have information about your name or any contact information. If you subscribe to our blog, then we will also collect your email address and ask you to create a username. If you subscribe to our paid services, then we will also collect your name, a username, password, email address, billing address, and credit card number. Some of that information is collected through third-party payment providers, like Stripe and PayPal. You should become familiar with their respective terms of use and privacy policies. We also ask for your education level and medical specialty.

This basic information is necessary to complete your user registration and for you to use our Services. If you decline to provide this information during the registration process, you cannot create an account or use our Services.

If you contact us and disclose additional personal information, we may store that information as well. This could include customer support queries from our users, inquiries from journalists or any other correspondence. The correspondence data may include the communication content and metadata associated with the communication, as well as any contact details you may provide to us, such as your name, email address, phone number, job title, address or social media username.

Whenever we collect personal identifying information from you on our Website, other than the IP address, it will be through a form where the information we ask for is clearly identified and you voluntarily provide it to us. By voluntarily providing us with any information, you represent that you are the owner of such personal data or are otherwise authorized to provide us with information and give us permission to use such information for the purposes set out in this Privacy Policy.

If we have some commercial relationship with you or with your employer (for example, a supply, purchase, sponsorship or referral relationship) then we may receive personal information, such as your contact details, any related communications, and any related documents (such as contracts, POs, invoices, proposals and so on). We process these for the purposes of administering our commercial relationship with you or your employer.

Your personal information may be provided to us by someone other than you. We might be introduced to you in correspondence by a mutual commercial partner, for example, or we might receive personal information through other users of our products or services. We may also obtain your personal information in the course of our market research, if you have a public profile associated with an entity with whom we do business or wish to do business. We also may choose to contract with salespeople who present to you at tradeshows or other public events, and who collect information on our behalf when they introduce you to our Services. Regardless of the source, once we have your personal information, we will treat it in accordance with this Privacy Policy, but we cannot make any representations about how others may handle that information.

We Do Not Collect or Store Patient Data

We do not, either directly, or through our Website or Services, collect or store any information that would be considered protected health information under the Health Insurance Portability and Accountability Act (“HIPAA”). To aid you in prescribing the correct medications in the right doses, our Website collects information like patient age, gender, and weight, but the Website does not, indeed cannot, collect any information that might be individually identifiable information and fall under the parameters of HIPAA.

Additionally, we do not store the limited data input into the Website for prescription calculation.

How We Use the Information We Collect

The information we gather is used primarily to fulfill the Services contracted for, to enhance the user experience, and to make our marketing efforts more effective. The specifics of the use of each kind of data are outlined below.

We gather anonymous, non-personally identifying information about our users, like that information collected through cookie technology, on an aggregate level only, which means the information is not linked or associated with your identity.

We may also use or share this information for research regarding the effectiveness of the Website, our marketing and advertising efforts, to analyze trends, administer the Website, track users’ movements, and gather broad information for aggregate use. To these ends, it may become necessary for us to disclose aggregate, anonymous data obtained from you to third parties. We do not link IP addresses with personally identifying information.

We treat personally identifying information differently than non-personally identifying information.

In addition to the uses identified elsewhere in this Privacy Policy, we may use or process information that we collect about you (including personal information that you provide) for a variety of carefully considered and specific purposes, including certain legitimate business purposes, which are in the interests of enhancing the Services that we provide and therefore are of great benefit to our users, such as

·      Provide, operate, maintain, enhance, personalize, promote or otherwise improve our Services/communications for the benefit of our users;

·      Enable personal identification within the Services or to register you as a member of the Services, including to facilitate your access to and use of the Services;

·      Send transactional messages to you, including responses to your comments, questions, and requests; provide customer service and support; and send you technical notices, updates, security alerts, and support and administrative information;

·      Ensure that the content of the Services is presented in the most effective manner for you and for your device;

·      Communicate with you in general (including for example and without limitation, via email) including to provide information about the Services;

·      Gather information to monitor and analyze trends, usage and activities in connection with the Services and for marketing or advertising purposes and to form statistical, modelling, and trend analysis with the aim of developing and improving products and services and also to determine the effectiveness of promotional campaigns and advertising activity;

·      Allow us to analyze usage and activity and improve Services for users;

·      Identify, investigate and prevent fraudulent, unauthorized access to the Services and other legal activities;

·      Enhance the security of our network and information systems;

·      Personalize the Services by, including, providing features that match your interests or preferences;

·      Meet legal requirements; and

·      For other purposes for which we obtain your consent.

Fortune Law Firm uses registration and subscription information, which includes personally identifying information, to maintain records about your use of our services, for billing purposes, and for us to occasionally send you information on updates and other products or services we offer.

We may retain personal information captured during the onboarding processes of legacy products (for example, it is foreseeable that future products may collect less information, in which case prior information you have provided will still be associated with your account).

We reserve the right to confirm the accuracy of registration data for medical verification purposes using external third-party sources, like open government databases or other data in the public domain.

The data we collect is stored indefinitely. If you wish us to delete data collected on your behalf, contact us at processor@fortune.law. We cannot guarantee deletion of all data, as there are third-party services (like Stripe or Paypal) who are also collecting data, but we can delete information associated with your account on our servers. Deletion of data will necessarily result in a cancellation of the subscription and the inability to use the Services.

Under What Circumstances We May Share Your Information

We do not sell personally identifying information.

We may disclose your personal information to other third parties designated by you, such as other users of our products to whom you have elected to show user-submitted content or anyone to whom you have asked us to forward correspondence.

We may provide personally identifying information to contractors or employees for the uses described in this Privacy Policy. For example, we may disclose personal data in our possession to suppliers that host the servers on which our data is stored. We may also provide correspondence data (names, email addresses, and cell phone numbers) to providers of messaging, email, or emails marketing services who would then manage our correspondence to you. We may also provide commercial information to our accountants or payment processing service providers for the purposes of fulfilling our tax obligations to the government or to facilitate the collection of payment from you.

We never share your personal information with commercial partners without your explicit consent, which we would obtain separately. You will be informed clearly and in a transparent manner on what type of personal data will be shared. As an example, we may share your personal information to register your interest in targeted campaigns placed in our products on behalf of our commercial partners. Targeted campaigns may include registering for conferences and training events, connecting with a medical device specialist, or marketing research. For the commercial partner to verify your professional status and contact you, we will share your name, email address, and perhaps textable phone number, but only with your explicit permission.

For non-personally identifying information, we may disclose this information to Contractors to analyze the performance of the Service and the behavior of users, and to operate and improve the Service. We may disclose or publish non-personally identifying information in the aggregate to any third parties, such as potential customers, business partners, advertisers, and funding sources, for the purpose of describing our business and operations and enticing investors, vendors, or potential subscribers.

Permitted Disclosures: Notwithstanding the above, we may use personal information to the extent required by law or legal process, or if in our reasonable discretion this use is necessary to investigate fraud or any threat to the safety of any individual, to protect our legal rights, or to protect the rights of third parties. If any part of our business is proposed to be sold or transferred, your personal data may be disclosed to the new owner or in connection with the relevant negotiations. We may disclose personal data to our legal and professional advisors and insurers to receive legal or professional advice or to manage legal disputes or potential legal disputes. These permitted disclosures may be without notice to you. By agreeing to this Privacy Policy, you specifically consent to such disclosure.

How Long Do We Keep Your Data?

We retain personal data or personal information for as long as necessary to provide our products and fulfill the transactions you have requested, or for other essential purposes, such as complying with our legal obligations and enforcing our agreements. Because these needs can vary for different data types in the context of different products, actual retention periods can vary significantly. The general rule that establishes the period of data retention is that data is stored and analyzed only for the length of time required to fulfill the purposes for which they were collected.

As exceptions to that general rule:

·      Data that is aggregated and anonymized (and which therefore no longer constitutes personal data) may be kept by us indefinitely;

·      We maintain system backups for disaster recovery purposes. That means that information deleted from our live systems may still remain in backup until the backup is overwritten (although we would make no use of it while in backup); and

·      We may retain your personal data or personal information longer than the usual retention period where necessary in connection with any legal claim, or where necessary to comply with law.

California Residents’ Rights Under the California Consumer Privacy Act

In this section, we have summarized the rights that Californian residents have under the California Consumer Privacy Act (CCPA). You should read the relevant materials from the regulatory authorities for the full details of these rights.

Your principal rights under the California Consumer Privacy Act (CCPA) are:

1798.105(a/b) The right to request the erasure of any personal information about the consumer which the business has collected from, or about, the consumer.

1798.110(a) The right to request that a business that collects personal information about the consumer disclose the following, upon receipt of a verifiable consumer request from the consumer:

1.   The categories of personal information it has collected about that consumer.

2.   The categories of sources from which the personal information is collected.

3.   The business or commercial purpose for collecting or selling personal information.

4.   The categories of third parties with whom the business shares personal information.

5.   The specific pieces of personal information it has collected about that consumer.

1798.115(a) The right to request that a business that sells the consumer’s personal information, or that discloses this for a business purpose, disclose to that consumer.

1798.120(a) The right, at any time, to direct a business that sells personal information about the consumer to third parties not to sell the consumer’s personal information. This right may be referred to as the right to opt out. (b) A business that sells consumers’ personal information to third parties shall provide notice to consumers, pursuant to subdivision (a) of Section 1798.135, that this information may be sold and that consumers have the “right to opt out” of the sale of their personal information. Pursuant to 1798.135. a consumer may authorize another person solely to opt out of the sale of the consumer’s personal information on the consumer’s behalf, pursuant to regulations adopted by the Attorney General.

1798.125(a) (1) A business shall not discriminate against a consumer because the consumer exercised any of the consumer’s rights.

1798.130(a) In order to comply with the sections above, a business shall, in a form that is reasonably accessible to consumers, a business shall: (1) make available two or more designated methods for consumers to subject request, (3) to determine whether the request is a verifiable consumer, and (2) disclose and deliver the required information in accordance with the California Consumer Privacy Act.

California also requires website operators like us to disclose how we respond to “Do Not Track Signals”; and whether third parties collect personally identifiable information about users when they visit us.

(1) We do not track users who do not interact with sharing functionality across the web, and therefore do not use “do not track” signals.

(2) We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate member consent.

All requests are subject to reasonable verification. Please be aware that you will be required to validate your identity to confirm you are the account holder in question, in line with the Attorney General’s established rules and procedures “to govern a business’ determination that a request for information received by a consumer is a verifiable request.”

We will (i) verify consumers’ or subject requests by using available data and implementing reasonable security measures, (ii) not collect new data for verification unless necessary for security purposes, and (iii) promptly delete newly collected information.

Users Outside of the United States

We and our servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access our Services, you consent to the use and disclosure of information in accordance with this privacy policy and subject to such laws.

Information You Collect/Store

The computer, tablet, phone, or other smart device you use to access the Website or App has several features that are designed to enhance the user experience with streaming, remote access of information, and other use of internet data. Among other things, your device likely “caches” or stores information (including from our Website and App) locally on your device to speed up access time for future interactions with websites, or in some cases allow offline access. Caching and other such features are device and user specific.
